Confiscated Land, Looted Art, and other Holocaust Era
Assets
ISRAEL
According to
the Custodian-General, commercial banks are currently
holding NIS 61 million in dormant accounts - those which
have had no activity for at least ten years. In addition
to 10,000 individual bank accounts worth NIS 350 million
currently in protective custody, the Custodian-General
administers 5,000 properties worth NIS 1 billion whose
owners are unknown. By
law, the Custodian-General may transfer property to state
ownership after 15 years if owners cannot be found. In
the past two years, NIS 10 million worth of dormant
accounts gone to the Treasury, while an undisclosed
amount has gone to the Israel Lands Administration.
In 1997 a list of 11,000
missing account owners was published, but of 400 claims
submitted only 10 have been paid. Current plans call for
a more diligent effort to track down lost owners and
heirs, particularly on accounts owed Holocaust victims.

Estimates are 2 million
living Holocaust survivors, many of whom live in Israel
and Eastern Europe. Most are entitled to
compensation/restitution as a result of atrocities
perpetrated against them, both by Nazis and
collaborators.
These acts included forced
and slave labor, confiscation of assets, and looting of
gold and art. Further, as a direct result of the
accompanying genocide, there exist a large number of
dormant bank accounts and unpaid life insurance policies,
which may be recoverable by rightful heirs.

victims and heirs may be entitled to receive part of a

AVOTAYNU website - www.avotaynu.com - offers a database of unclaimed swiss
accounts and other Holocaust-era assets, and "Living
Heirs" - www.livingheirs.com - is a site established to help
Holocaust victims and their heirs establish entitlement.
The International
Commission on Holocaust Era Insurance Claims (ICHEIC),
also known as the Eagleburger Commission, was established
in 1998 to expedite the location of lost and unpaid
Holocaust-era insurance policies. Visit their website: www.icheic.org for information and assistance.
Survivors and heirs should
also check the unclaimedassets.com pages of the following
countries: Austria ($40 million settlement fund arising from
litigation against Austrian banks); Switzerland ($1.25 billion compensation fund
established by Swiss banks); Germany ($5.2 billion fund to compensate forced and
slave laborers); France (French Bankers Association initiative to
refund dormant accounts); United Kingdom (list of 25,000 owed property
confiscated by the Custodian for Enemy Property); and Czechoslovakia (list of those owed confiscated
property and unpaid insurance claims).
A State of California law
scheduled to take shortly requires insurance companies
doing business in the state to publish the names of
owners and beneficiaries of Holocaust-era policies, so a
regular check of the California Comptroller's site is a good idea.

Assets may be held in
Israel, as well. In the early 1930s, thousands of
European Jews opened accounts at Anglo-Palestine Bank.
Typically these contained £1000 (British) or more, the
amount required to receive an entry permit into Mandate
Palestine. Under British Mandate regulations the funds
were later frozen, classified as belonging to residents
of enemy countries.
While many account owners
and heirs had been lead to believe the money was
transferred to Britain, it was later discovered it had
never left the country. A lawsuit recently filed in
Jerusalem's Magistrate's Court alleges Anglo-Palestine
Bank's successor, Bank Leumi is withholding information
on some 6,000 accounts worth $120 million.
On January 18, 2000, Bank
Leumi admitted to holding 13,000 unclaimed accounts worth
NIS 7.8 million, many of which are believed to belong to
victims of Nazi atrocities. A list of accounts dormant
since 1955 is now available at: www.bankleumi.co.il (Hebrew) / www.bankleumi.com (English); and at bank branches in Tel
Aviv, Jerusalem, Haifa and Beersheba. Claimants have six
months in which to present claims. After a six month
processing period, unclaimed funds will be transferred to
the Custodian-General.
Note that in addition to
bank accounts, a number of European Jews invested in
land. Several companies, including Kehilat Zion America
(KZA), sold lots in the northern part of the country.
After the war, abandoned parcels were transferred to the
Jewish National Fund. Subsequently the Custodian-General
took possession, but in some cases, title passed to the
Civil Administration in the territories where the land

VETERANS BENEFITS ADMINISTRATION, DEPARTMENT OF VETERANS AFFAIRS
AUTHORIZATION:
War Risk Insurance Act, as amended, Public Law 65- 90; World War Veterans Act, Public Law 68-242, as amended; National Service Life Insurance Act, Public Law 76-801, as amended; Servicemen's Indemnity and Insurance Act, Public Law 82-23; Public Law 88-664; Public Law 92-95, as amended; 38 U.S.C. 1903, 1922, 1923, 1925, 1941 and 2106.
OBJECTIVES:
To provide life insurance protection for veterans of World War I, World War II, Korean conflict and service-disabled veterans separated from active duty on or after April 25, 1951, and to provide mortgage protection life insurance for those disabled veterans who are given a VA grant to secure specially adapted housing under Chapter 21, Title 38, U.S.C.
TYPES OF ASSISTANCE:
Direct Loans; Insurance.
USES AND USE RESTRICTIONS:
Life insurance settlement upon death of insured; or the insured may personally surrender a permanent plan policy for cash; or the insured may be granted a loan up to 94 percent of the cash surrender value of a permanent plan policy. Interest on United States Government Life Insurance (WWI) policy loans is charged at the rate of 5 percent per annum. Interest is charged at a variable rate which may change annually for National Service Life (WWII), Veterans Special Life (Korean conflict), Service-Disabled Veterans (Korean Conflict and Continuing) and Veterans Reopened Insurance policies. The variable rate equals the yield on the Ten-Year Constant Maturities Index for U.S. Treasury Securities for the month of June of each year rounded down to the next whole percentage. This loan rate is effective from the first day of October of each year and will not exceed 12 percent or be lower than 5 percent per annum. Dividends are paid on United States Government Life (WWI), National Service Life (WWII), Veterans Special Life (Korean Conflict), and Veterans Reopened Insurance. Dividends are not paid on Service-Disabled Veterans Insurance (Korean Conflict and continuing), or the Mortgage Protection Life Insurance. The face amount of the policy, less any indebtedness on the policy, is payable to the designated beneficiary upon the insured's death under a regular life policy, and only to the mortgage holder under the Mortgage Protection Life coverage.
ELIGIBILITY REQUIREMENTS:
Applicant Eligibility:
All of the programs are closed for new issues except Service-Disabled Veterans Insurance and the Mortgage Protection Life Insurance. A veteran discharged from active military duty, on or after April 25, 1951, who has a service-connected disability for which compensation would be payable if 10 percent or more in degree, and who, if not for the disability would be otherwise insurable in accordance with the established standards of good health, applies for such coverage within 2 years from the date of notice of the VA service- connected rating, may be issued Service-Disabled Veterans Insurance. (The time period in which to apply is limited to one year from the date of notice of the VA service-connected rating if the notice was provided before September 1, 1991.) A veteran insured under Service-Disabled Veterans Insurance who qualifies for waiver of premiums, who is under age 65 and who applies within one year from date of notice from VA that he/she qualifies for waiver of premiums or before November 1, 1992, whichever is later, may be issued Supplemental Service-Disabled Veterans Insurance coverage. A veteran who has been given a VA grant for specially adapted housing will be sent notice that he/she is automatically insured for mortgage protection unless he/she elects in writing not to be so insured, or fails to respond within 60 days after a final request for information on which premium can be based is mailed to him/her.
Beneficiary Eligibility:
The veteran may apply for either type of insurance. However, if the veteran is mentally incompetent, a VA recognized fiduciary may apply on his/her behalf for Service-Disabled Veterans Insurance. Service-Disabled Veterans Insurance may also be granted under certain conditions to mentally incompetent veterans who were otherwise eligible for such insurance, but due to their incompetency, died without filing an application.
Credentials/Documentation:
If a veteran does not initially take the automatic Mortgage Life Insurance, he/she may apply later but will be required to submit evidence that he/she meets established health requirements.
APPLICATION AND AWARD PROCESS:
Preapplication Coordination:
None. This program is excluded from coverage under E.O. 12372.
Application Procedure:
Upon receipt of VA's notice of eligibility for Service-Disabled Veterans Insurance, a veteran may apply by submitting the application on VA Form 29-4364. Upon receipt of notice from VA that he/she qualifies for waiver of premiums, an individual insured under Service-Disabled Veterans Insurance may apply for additional supplemental coverage by submitting an application on VA Form 29-0190. He/she may be guided by VA Pamphlet 29-9 in selecting the type of policy. The form and pamphlet may be obtained from the nearest VA office (listed in Appendix IV of the Catalog) and submitted to the Philadelphia VA Regional Office and Insurance Center, P.O. Box 7208, Philadelphia, PA 19101. A veteran eligible for the Mortgage Protection Life Insurance need only submit information and documentation to the Philadelphia VA Regional Office and Insurance Center, P.O. Box 7208, Philadelphia, PA 19101.
Award Procedure:
Service-Disabled Veterans Insurance is issued by the Philadelphia Regional Office and Insurance Center to any veteran meeting the requirements listed under Applicant Eligibility above. Mortgage Protection Life Insurance is automatically issued to all veterans receiving a grant for specially adapted housing.
Deadlines:
Generally within 2 years following the date of notice of VA's service-connected rating for Service-Disabled Insurance (The time period in which to apply is limited to one year from the date of notice of the VA Service-Connected rating if the notice was provided before September 1, 1991.) Check with local VA office for exceptions. For Service-Disabled Veterans Insurance supplemental coverage, the time period in which to apply is one year from the date of VA's notice that the veteran qualifies for waiver of premiums or before November 1, 1992, whichever is later. For Mortgage Protection Life Insurance the veteran must respond within 60 days of a final request for information.
Range of Approval/Disapproval Time:
From 1 to 3 months upon application for Service-Disabled Veterans Insurance after VA's notice of the service-connected rating. The time frame for approval/disapproval after an application for Supplemental Service Disabled Veterans Insurance coverage is received in VA is 1 month. Mortgage Protection Life Insurance is effective immediately upon approval of a specially adapted housing grant.
Appeals:
If the application for insurance is denied, the veteran may file an appeal with the Board of Veterans Appeals, VA Central Office, 811 Vermont Avenue, NW., Washington, DC 20420, up to 1 year after the date of the notice of denial.

PROGAM ACCOMPLISHMENTS:
Since the inception of the USGLI, NSLI, VSLI, VRI, and S-DVI programs, $84.2 billion have been collected as income to the funds, $68.9 billion have been distributed to policyholders and beneficiaries and $15.3 billion are currently being held in reserves for the payment of future liabilities of the funds. At the end of 1999, almost 2.3 million of over 24 million policies originally issued remained in force.

Web Automated Verification of Enrollment (WAVE) is
open.
IMPORTANT NOTE: You MUST be currently
enrolled in some form of approved educational
program, have a
current or active benefit award for MGIB- Active Duty
(Chapter 30) in our system AND have recently received a
VA Form 22-8979 in the mail. If these conditions are not met you will not have a record in the
WAVE system.
State Jurisdictions Realigned.
Effective April 5, 2002, all education benefit
claims for veterans and beneficiaries attending school
in Arkansas will be processed by our Muskogee Regional
Processing Office. E-mail and telephone service
have been automatically changed to reflect this change
in jurisdictions. This change will require NO ACTION
on the part of veterans and beneficiaries.

Verification of Enrollment - Just call 1-877-823-2378 and follow the prompts.
Use of this system eliminates the need for the student
to sign and return the VA Form 22-8979 every
month. Note: If you did not receive a VA
Form 22-8979 to complete, you will not be able to use
the system because no monthly verification is required
at this time.

When a Veteran Dies
Things to do..
WHEN A LEGIONNAIRE DIES!
It is important to:
1. Contact your funeral director for burial arrangements.
2. Contact the Pastor of your church.
3. Furnish the funeral director a certified copy of the
veteran's discharge, separation notice DD form 214, Veterans
Administration claim number, if known, and the veteran's
social security number.
4. The funeral director should apply for the U.S. Flag to
drape the casket, or contact local postmaster.
5. The funeral director should apply for the amount allowed
from DVA toward burial expenses, also the allowed amount from
social security; (a) $300. Burial Allowance [$1,100 Service
Connected]' (b) $150. Plot or Interment Allowance, [1} If
meets eligibility requirements, (c) Headstone or Grave
Marker, [1} No payment in lieu of.
6. When the veteran is a member of the American
Legion , as soon as
possible, the member's Post Commander or Chaplain should be contacted for the ritual service and
casket bearers, if needed. If it is the desire of the family
to have the U.S. Flag presented to the next of kin during
grave side services, please notify the Post Commander or Chaplain also.
7. The American Legion Post Service Officer or the Dept.
Service Officer, will
assist you in applying for the benefits you may be entitled
to through the DVA. Widow or Children Compensation (DIC) b.
Widow or Children Pension (Death Pension).
8. Important documents to have available when applying for
assistance;
1.
Honorable Discharge (original, if available) or the DD
Form 214 or equivalent Separation papers,
2. Marriage License (original or certified copy),
3. Birth Certificates of children: (original or
certified), a. under 18 yrs old or 18 to 24 and Full Time
student,
4. Death Certificate (certified copy),
5. Veteran's social security card and claim # with the
DVA,
6. Divorce papers (if applicable),
7. Adoption papers (if applicable),
9. The
previously listed documents may also be needed and necessary
with the Social Security Administration.
10. Insurance-A certified copy of death certificate is always
required for beneficiary to receive payment. The Post Service
Officer should be able to assist when applying for Government
Insurance (GI Insurance) by supplying and completing the
required DVA Form (29-4125). Many Legionnaires carry Life
Insurance under plans offered thru the National American
Legion Life Insurance Plan. These claims should be filed with
the following;

when in doubt. If Life Insurance is carried with other
commercial companies, contact the agent of that company in
your area for further assistance. If the veteran's death was
accidental, there may be ACCIDENTAL DEATH benefits available
through the veterans Legionnaire membership, check with the
Post Adjutant.
11.. Always contact your American Legion Post Service Office
for information concerning benefits that may be available for
the widow and/or dependent children, including Soldiers',
Sailors' and Marines' Fund assistance.
In Massachusetts, contact the Department of
Massachusetts, 617- 727-2966 for the American Legion Post
nearest you or for information on how to contact the Department Service
Officer.
