Business Travel Insurance
The University maintains a business travel insurance policy
that provides worldwide coverage for accidental death or
dismemberment while an employee is traveling on official
University business. Official travel is defined as travel on
official University business from one's home or normal place of
employment to another destination, including University
facilities outside the Boston metropolitan area. Official travel
does not include commuting to and from work.
The business travel insurance benefit level is five times
annual earnings, with a minimum of $250,000 and a maximum of
$500,000 per person. Employees traveling together should be aware
that the University has a maximum limit of $2,000,000 per
conveyance, such as aircraft or automobile. Therefore, employees
are encouraged to travel in groups of no more than four.
Coverage begins when the employee leaves his or her residence
at the start of a business trip, and ends when the employee
returns to his or her residence. The policy covers limited side
trips (1-2 days) made for personal reasons during the trip, but
not the days before or after the trip.
Students, consultants, and other non-employees are not covered
by University business travel insurance.
All travel insurance questions should be directed to Lee Ann
Ross, Insurance Office, 495-8668, before arranging the trip.
Corporate Card Insurance
See Corporate Card Benefits for a complete description of insurance coverage provided
through the American Express Corporate Card.
Personal Property
The University maintains no insurance for loss of or damage to
personal property during official travel. Travelers:
. should seek reimbursement through their own insurance
company or directly from the responsible party.
. should seek reimbursement through American Express if
airfare was purchased with the Corporate Card or the Travel
Authorization Form.
. will not be reimbursed for purchase of personal
property insurance.
University Property
The University does not automatically insure Harvard-owned
equipment or building contents. An individual traveling with
University equipment should contact the Insurance Office at
495-7971 to discuss the need for insuring valuable items that
will be taken on a business trip.
International Travel With University Property
To determine insurance needs, travelers carrying large pieces
of equipment or materials that must pass through customs in
foreign countries should contact the Insurance Office prior to
their trip. The Insurance Office can assist the traveler in
obtaining a CARNET bond which will allow a traveler to easily
move the materials through customs.
War Risk Insurance
The U.S. State Department issues travel advisories to warn
against travel in countries declared to be a war risk. Travel
agencies have a current listing of war risk countries available
through their reservation system. Travel in war risk countries is
excluded from coverage under the University Business Travel
Insurance. Anyone traveling on University business to a war risk
country should purchase war risk insurance prior to their trip.
Federally-funded sponsored projects contractually require
travelers to purchase war risk insurance whenever traveling to a
war risk country. Please contact the University Insurance Office
at 495-8668 for enrollment information.
Medical Evacuation Insurance
Prior to traveling to a third world or developing country, it
is advisable to purchase medical evacuation insurance. Standard
medical evacuation insurance provides coverage for the cost of
the traveler's evacuation to the closest medical facility capable
of providing the necessary treatment. If a traveler remains
hospitalized for more than seven days, this coverage includes the
cost of transportation to the medical facility for a person
designated by the traveler.
The cost of medical treatment is not covered by evacuation
insurance. It is travelers' responsibility to make sure they have
adequate health coverage when traveling internationally. Harvard
employees can contact the Benefits Office at 495-7785 to inquire
about coverage under their Harvard health plan.

PER CURIAM:
This case raises two issues. First, whether a primary insurance carrier owes
a duty to an excess carrier in its conduct of the defense of a mutual insured.
Second, whether an excess insurer can be equitably subrogated to the rights of an
insured against the primary carrier in the conduct of its defense of the mutual
insured. Because these issues are questions of state law which appear to control
the outcome of this appeal and there are no clear controlling precedents in the
decisions of the Alabama Supreme Court, we certify both questions to the
Alabama Supreme Court under Rule 18 of the Alabama Rules of Appellate
Procedure.

COURT OF ALABAMA, PURSUANT TO RULE 18, ALABAMA
RULES OF APPELLATE PROCEDURE.
I. Style of the case
The style of the case in which this certification is made is Federal Insurance
Company, individually, Pearce Construction Company, Inc., through assignee
Federal Insurance Company, Plaintiffs-Appellants, versus Traveler's Casualty and
Surety Company, Traveler's Property Casualty Corp, Aetna Casualty & Surety
Company, Defendants-Appellees, case No. 01-13734-AA , United States Court of
Appeals for the Eleventh Circuit on appeal from the United States District Court
for the Northern District of Alabama.
II. Facts
The facts of this case are undisputed. A construction accident occurred on
June 27, 1995. Barry Wayne Gulley, an employee of Kennon Excavating &
Construction Company, was killed on that date when a masonry wall fell on him
and crushed him to death. Pearce Construction Company had constructed the wall
in 1987.
Gulley's personal representative filed a lawsuit against Pearce Construction
Company in the Circuit Court of Morgan County, Alabama. Pearce Construction
Company had a general comprehensive policy of primary liability insurance with
Aetna (now Travelers). This policy afforded Plaintiff $1 million of primary
liability coverage. Pearce Construction Company had purchased excess insurance
from Plaintiff Federal Insurance Company. The policy limits of the excess
coverage were $10 million. The parties engaged in settlement negotiations prior
to the jury trial in Gulley . The settlement negotiations were unsuccessful. Prior to
the jury verdict in Gulley , the highest verdict ever returned by a Morgan County
jury was $225,000. The Gulley case could have been settled for $350,000 but
Aetna would not agree to pay that amount.
The case proceeded to trial, and the jury returned a verdict for $4.6 million.
The judgment was appealed, but the parties settled the case, with Defendant
paying the limits of its primary coverage ($1 million) and Plaintiff paying the
balance of $3.6 million.
III. Questions to be certified
1) Whether a primary insurance carrier owes a duty of good faith in
each, or all, of the following duties to an excess carrier in its conduct
of the defense of an insured who is insured by both. The relevant
duties are: duty of good faith to settle; duty of good faith in deciding
whether to settle; duty of good faith to keep excess carrier informed
of settlement negotiations and adverse defense developments.
2) Whether an excess insurer can be equitably subrogated to the rights
of an insured arising out of any of the foregoing duties against the
primary carrier in the conduct of its defense of the mutual insured.
The particular phrasing used in the certified question is not to restrict the
Supreme Court's consideration of the issues in its analysis of the record certified
in this case. This latitude extends to the Supreme Court's restatement of the issue
or issues and the manner in which the answers are given. See Lashburn v. Rabun ,
755 F.2d 1404 (11th Cir. 1985).
The clerk of this court is directed to transmit this certificate, as well as the
briefs and record filed with the court, to the Supreme Court of Alabama, and
simultaneously to transmit copies of the certificate to the attorneys for the parties.

UniversityOwned Vehicles
Employees authorized to travel on official university business are covered by the Arizona Department of Administration Risk Management Section insurance program for liability and workers' compensation coverage while in the course and scope of their employment. Universityowned and leased property is covered by property insurance and coverage is provided worldwide.
Universityowned vehicles are covered with liability and property damage insurance when being driven on official university business. Certain limitations related to medical coverage for passengers not employed by the university and other restrictions exist and are explained in the Fleet Service pamphlet Use of State Vehicles.
Privately Owned Vehicles
Employees authorized to operate privately owned vehicles while on official university business must have a valid driver's license for the type of vehicle being operated and at least the minimum vehicle insurance coverage required by the state of Arizona. The state's vehicle liability insurance provides coverage to employees to supplement their personal insurance while using privately owned vehicles on authorized university business. However, the traveler's personal insurance policy is considered to be the primary insurer and must respond to the limit of the policy in an accident involving the privately owned vehicle. The state's insurance policy provides coverage for the employee's liability in excess of the employee's provided policy limits. Regardless of who is at fault, the state will not reimburse the traveler for any comprehensive or collision damage to a privately owned vehicle.
State insurance coverage does not apply to any vehicle when used outside the scope and course of employment, such as during vacation taken in conjunction with authorized university travel.
Rental/Leased Vehicles
The use of rental/leased vehicles may be authorized only when it is to the advantage of the university and not for the personal convenience of the traveler. Authorization to rent/lease a vehicle when in travel status must be specifically noted and approved on a Travel Authorization form.
The Arizona Department of Administration Risk Management Section provides liability and property damage coverage for rental/leased vehicles used for official university business. Therefore, the insurance options offered by the rental/leasing agency are not reimbursable for travel within the United States. When the use of a rental/leased vehicle is required, the traveler must refuse the collision and liability insurance unless in foreign travel status.
Foreign Travel Vehicle Insurance
Universityowned and leased vehicles used for international travel are covered for automobile liability and property damage with worldwide coverage. However, due to some variations in local laws, the purchase of local insurance might be necessary. Leased vehicles will usually be covered by owner provided insurance coverage. The traveler must confirm local requirements and purchase appropriate coverages as the local laws require as necessary, and to ensure adequate coverage.
Mexican authorities do not recognize insurance policies from the United States. State Risk Management Section maintains a Mexican automobile, aircraft, and general liability insurance policy which covers university employees traveling in Mexico on official university business. Only universityowned vehicles are covered for automobile liability, and proof of insurance must be maintained in the vehicle at all times. Proof of insurance can be obtained prior to any trip into Mexico from ASU Fleet Service at 480/9653496.
Procedures
What to Do in Case of an Accident
Domestic Travel Accidents
Report all property loss claims as soon as possible to ASU Risk Management at 480/9651823 (480/9653456 for after-hour emergencies). Instructions on filing a claim will be given at that point and are described in the Risk Management Policies and Procedures Manual- RSK 302 , "Vehicle Loss Insurance Recovery."
In the event of a work-related illness or injury seek appropriate medical attention. Contact ASU Human Resources Benefits Office at 480/7276337 (480/9653456 for after-hour emergencies) within 48 hours of the illness or injury to file a workers' compensation claim.
Foreign Travel Accidents
Report all automobile accidents in accordance with local requirements and special provisions contained in separately purchased automobile liability policies. In addition, contact ASU Risk Management as soon as possible at 480/965-1823 (480/965-3456 for after-hour emergencies) to report the accident.
Travel Assistance Services
A new program is available to all state agencies including ASU. This program, Travel Assistance Services, provides specific services and benefits to all full-time university employees traveling on official university business 100 miles or more from their home. The program provides predeparture assistance, travel medical emergency assistance, medical evacuation and repatriation assistance, insurance assistance, and personal assistance. In addition, travel assistance can be offered to an employee's traveling companion or minor children.

INSURANCE COVERAGE FOR FOREIGN TRAVEL
University employees who travel on authorized university business outside
of the United States are provided insurance coverage for liability and
workers' compensation through the university's self-insurance
administrator, Arizona Department of Administration, Risk Management
Section, in accordance with State law. University property used in
authorized foreign travel is covered under the university's property
insurance coverage program. The university's foreign travel policy is
available on-line .
WORKERS' COMPENSATION FOR FOREIGN TRAVELERS
In the event of a work-related illness or injury, seek appropriate medical
attention. Contact ASU Human Resources Benefits Office at (480) 965-2701,
the State of Arizona Workers' Compensation Early Claims Reporting Service
at (800) 837-8583, and your immediate supervisor within 48 hours of the
illness or injury to file a workers' compensation claim.
TRAVEL TO SANCTIONED COUNTRIES
Foreign workers' compensation and liability coverage may not be provided
for employees traveling to federally sanctioned countries unless the
traveler notifies State Risk Management to purchase insurance at least two
months in advance.
A list of federally sanctioned countries is available on the
U.S. Treasury web site . Employees
traveling to federally sanctioned countries on ASU business must determine
if a license is necessary from the U.S. Treasury Department, and, if so,
to submit the license along with the travel dates, specific purpose of the
trip, and a copy of the travel itinerary to ASU Risk Management. Travel
dates, specific purpose of the trip, and a copy of the itinerary must be
submitted irrespective of whether a license is a requirement for travel to
a specific federally sanctioned country.
ASU Risk Management will submit all documentation to State Risk Management
for their determination if additional insurance is necessary. The
traveler's department is responsible for the cost associated with
purchasing additional insurance.
EMERGENCY TRAVEL ASSISTANCE SERVICES
Domestic and international emergency travel assistance services are
available for university employees during travel provided such travel is
at least 100 miles or more away from the traveler's permanent address.
Services are provided to assist university employees when emergency
situations arise during university business travel. Assistance services
include:
* medical emergency services coordination;
* emergency medical evacuation assistance;
* repatriation coordination;
* legal referral assistance;
* emergency travel agency services;
* pre-trip assistance;
* emergency message service;
* emergency translation service;
* medication shipment service;
* lost document service; and
* lost luggage assistance.

Additional information on these services is available at the

Office web site or by contacting ASU Risk
Management prior to travel departure to obtain the travel assistance
services brochure. The web site and brochure contain an identification
card for the traveler.
Coverages and services apply only to university employees while traveling
on behalf of the University. Travelers should contact their personal
health care insurer for details on their medical coverage should the
traveler become ill or injured when unrelated to university business.
OWNED AND LEASED VEHICLES INSURANCE FOR FOREIGN TRAVELERS
University-owned vehicles used for international travel are provided the
same coverage as with domestic travel. However, due to variations in the
local laws of some foreign countries, it may be required to purchase local
insurance. The traveler must confirm local requirements and purchase
appropriate coverages as local law requires and ensure adequate coverage
is in-place. Liability and property insurance coverage shall be purchased
by the traveler for any leased/rented vehicle used in international
travel.
MEXICAN INSURANCE
Mexican authorities do not recognize insurance policies from the United
States. Risk Management Section maintains a Mexican automobile, aircraft,
and general liability insurance policy which covers university employees
traveling in Mexico on authorized university business. Only university
owned vehicles are covered for automobile liability and proof of insurance
must be maintained in the vehicle at all times. Proof of insurance can be
obtained prior to any trip to Mexico from ASU Fleet Service at (480)
965-3496.
SAFETY AND SECURITY FOR INTERNATIONAL TRAVELERS TRAINING PROGRAM
A one hour training program on safety and security for international
travelers is offer by Risk Management. All university foreign travelers
are encouraged to attend the training prior to any planned international
travel. Domestic travelers are encouraged to attend also. The training is
intended to increase an individual's awareness to the potential dangers
involved
with traveling in today's world. Topics include precautions a traveler can
take to reduce the risk of being victimized by a criminal assault,
kidnapping or theft and tips for handling difficult situations that may
arise when traveling by automobile, commercial airliner or other means.
Also, insurance requirements for travel to sanctioned countries will be
addressed.
Travelers are encouraged to schedule for the Safety and Security for
International Travelers Training Program prior to any planned travel.

Risk Management Environmental Health and Safety Training web site for
class dates, times, and registration or contact Risk Management at (480)
965-1823.
PROPERTY LOSS AND LIABILITY CLAIM REPORTING REQUIREMENTS
Report all university property losses and potential liability claims as
soon as possible to ASU Risk Management at (480) 965-1823 or (480)
965-3456 for after-hour emergencies. Instructions on filing a claim will
be provided at that time. Report all automobile accidents in accordance
with local requirements and special provisions contained in separately
purchased automobile liability policies. In addition, contact ASU Risk
Management as soon as possible at (480) 965-1823 or (480) 965-3456 for
after hour emergencies to report the accident.
