Banks and Banking - Loan Transaction - Default - General Personal Jurisdiction - Subsidiaries
Where a South Carolina corporation sued a bank holding company for multiple causes of action arising from a loan transaction, arguing that South Carolina has general personal jurisdiction over the holding company through the activities of its wholly owned subsidiary located in S.C., the Circuit Court properly dismissed the action since South Carolina cannot exercise general personal jurisdiction over the bank holding company based on the mere presence in this state of a wholly owned subsidiary and unified advertising strategy. Affirmed.

Real Property - Railroad Crossing - Fee Simple Determinable - Easement
Where a railway company, which was involved in a property dispute with the respondent over a strip of land encompassed by the railroad tracks, argued that it acquired a fee simple determinable interest in the land under the language of its 1845 charter, the Circuit Court properly held that the property in question is owned by the respondent since the 1845 charter created only an easement in the railway company. Affirmed.

A Message from Attorney General Charlie Condon:
Statistics on the occurrence of insurance fraud are shocking for two reasons. First, they reveal the high cost of insurance fraud to all policy holders. Second, they expose the level of public tolerance for such criminal activity. It's bad enough to know that the average out-of-pocket could be reduced by almost $1,000 if we could put and end to insurance fraud. It's worse to realize that almost one-third of the American people think it's "all right" to commit such a crime.
As Attorney General of South Carolina, I assure you that we have zero tolerance for insurance scams in this state. Recently we formed a special unit to investigate and prosecute these crimes. In addition, we installed a hotline devoted exclusively to receiving reports concerning insurance fraud. If you're aware of anyone who is bilking insurance companies, please let us know. Your name will be held in strictest confidence.
Together we can reduce the amount of insurance fraud in our state and in so doing reduce future premiums for all South Carolinians.
$1,030 per year, that's what the average American household pays every year in out-of-pocket-costs as a result of insurance fraud!
If insurance fraud was a business, it would be a top Fortune 500 company. Auto, home and business insurance fraud cost Americans more than $85 billion a year.
Fraud could be as simple as misrepresenting facts on an insurance application or "padding " or inflating actual claims or as serious as submitting claims for injuries or damage that never occurred and "staging" accidents. At least 10% of all auto, home and business insurance claims are either fraudulent or highly inflated.
Research indicates that the public's attitude about insurance fraud has grown increasingly tolerant in recent years. Studies show that 1 in 3 Americans believe it is "all right" to pad claims to make up for premiums paid in previous years when they had no claims. Most people think that fraud is a victimless crime, but You Are the Victim. Insurance fraud directly affects the amount you pay for health, auto and homeowner's insurance and increases the prices you pay for goods and services.
A new program in South Carolina will help you stamp out insurance fraud and hold down premiums for you and others: The South Carolina Insurance Fraud Hotline.
South Carolina Attorney General Charlie Condon's Insurance Fraud Division, in conjunction with the Professional Insurance Agents of South Carolina and the South Carolina Insurance News Service, has established the Insurance Fraud Hotline, available 24 hours a day.
South Carolina has a mandatory reporting act that states " ...any person, insurer or authorized agency having reason to believe that another has made a false statement or misrepresentation or has knowledge of a suspected false statement or misrepresentation shall, for purpose of reporting and investigation, notify the Insurance Fraud Division of the Office of the Attorney General of the knowledge or belief and provide any additional information within his possession relative thereto. "
If you suspect someone has committed any type of insurance fraud, call the South Carolina Insurance Fraud Hotline toll free. You don't have to reveal your identity.
Seven of the Most Common Types of Insurance Fraud:
Under reporting the number of miles you drive on your auto policy.
Failing to report an accurate medical history when applying for health insurance.
An employee of a company who fakes or exaggerates injuries to avoid work and draws workers' compensation payout.
An auto accident victim who falsifies or overstates injuries--or even fakes the accident--to achieve a large settlement or award.
Staging automobile accidents which result in inflated injury claims.
An insured who draws accident and health insurance benefits because of exaggerated or even fabricated injuries or illness.
Exaggerating the amount and value of items stolen from a home or business.

Insurance Costs
BUYING
A POLICY
Auto
insurance rates differ from company to company, driver to driver,
car to car, territory to territory, and protection to protection.
When
you buy automobile insurance, you should know what is considered by
insurance companies in arriving at your premium. The process of
pricing insurance is called rating, and the factors generally
considered by companies in rating are:
WHERE
YOU LIVE
The
county in which you garage your car is used as a rating factor in
South Carolina. Rates within each rating territory (a single county,
or a group of counties) do differ.
HOW
YOUR CAR IS USED
If
your car is used for pleasure purposes only, you will pay one of the
lower rates offered by your insurance company. The distance you
drive to and from work affects your premium. The use of the car for
business purposes will make your rates higher.
AGE,
SEX AND MARITAL STATUS
Your
age, sex and marital status are also factors used in determining
your automobile rates. Contact your insurance agent or company for
more information.
ACCIDENTS
AND VIOLATIONS
Your
driving record and those of the members in your household who drive
are extremely important considerations. Automobile insurers
operating in South Carolina must utilize two different rates for
automobile liability insurance: a "base rate", and a rate
25% higher than the "base rate", called the
"objective standards rate", which applies to operators on
an individual basis determined by traffic violations, accidents or a
combination of both. A driver purchasing physical damage insurance
who "fails" the "objective standards" test or
does not qualify for the safe driver discount may be charged a
higher rate for collision and comprehensive coverages.
South
Carolina has a uniform merit rating system, used by all companies,
primarily based on convictions for moving traffic violations and/or
accidents. Points are assigned based on the type of violation with
the most severe having higher point values. The uniform merit rating
system applies to both, "base rates" and "objective
standards rates". The first point assigned to each vehicle
eliminates the safe driver discount for that vehicle. For each point
in excess of one, an annual surcharge of $20 for liability and $20
for collision is applied. The uniform merit rating system
"points" - which are different than the Department of
Public Safety driver license "points" - are also used to
calculate the amount of Reinsurance Facility "recoupment"
charge you have to pay.
YOUR
CAR TYPE
The
year, make, model, and any other items affecting the value of your
car are important factors. The less it costs to repair or replace
your car, the lower the cost of your premiums for comprehensive and
collision coverages.
COVERAGES,
LIMITS AND DEDUCTIBLES
The
more insurance protection you purchase the higher your premiums will
be.
REQUIRED
DISCOUNTS
A
Safe Driver Discount of at least 20% below the "base rate"
shall apply to each automobile, if no surcharge points have been
incurred by the driver assigned to the vehicle, within the 36 months
prior to the effective date of the policy or renewal thereof. The
Safe Driver Discount will not apply to a vehicle assigned an
operator that has been licensed for 12 months or less. Discounts
also required are:

multi-car discount of at least 20% for liability and 10% for
collision for two or more cars insured with the same company not
used for business nor owned or operated by persons under 25
years of age; and,
A
Driver Training Discount of at least 10% for liability and
collision for an operator under the age of 25 who successfully
completes an approved Driver Training Course.
DRIVER
EDUCATION DISCOUNT
A
Driver Education Discount shall apply to liability and collision,
for an operator 25 years of age and older who successfully completes
an approved driver education course. The discount is afforded to the
operator for 36 months from completion of the course, subject to
conditions required by the company. Eligibility and percentage of
discount should be obtained from the company or your agent.
OPTIONAL
DISCOUNTS
A
company may extend the multi-car discount in a non-discriminatory
fashion to all drivers under 25. Other optional discounts are
bumper, passive restraint, air bag, anti-locking brakes, good
student and defensive driving course discounts. Be sure you ask
about these options because not all companies offer the same
"optional discounts". However, when they do, they must be
on a non-discriminatory basis.
