Every employer, large or small, faces the reality that it will be the target of legal action from past, present, and prospective employees.
Not only are the numbers of employment-related claims increasing, but so is the potential financial risk to your business. Defending a wrongful termination or discrimination claim -- whether you are innocent or guilty, or even if the claim is groundless or fraudulent -- can be expensive. The potential exposure for a money damages award threatens your company's limited financial resources.
Consider the Following Facts:
From October 1, 1993 through September 30, 1994, the Equal Employment Opportunity Commission and related state and local agencies received 156 discrimination complaints. As of May 1, 1995, the Equal Employment Opportunity Commission had a backlog of over 100,000 complaints and the average complaint took more than a year to handle.
From 1991 to 1993, the number of sexual harassment charges filed with the Equal Employment Opportunity Commission increased from 3,300 to 7,200.
A recent telephone poll found that almost 31% of all female workers claimed to have been the object of sexual harassment at work. Seven percent of all male workers also claimed to have been sexually harassed.
Through legislation like the Americans With Disabilities Act and the Family Medical Leave Act, Congress has created new grounds for employers to be sued.
In the face of this increased risk to your business, it is also increasingly likely that your current insurance excludes coverage for employment-related claims. Most comprehensive general liability policies specifically exclude employment-related claims. For the small for-profit business, a directors and officers policy may offer a limited form of insurance coverage, but will probably not extend coverage to the business entity. Other forms of insurance, such as fiduciary liability coverage, are unlikely to cover these types of claims.

Every business needs insurance to protect against potential loss or damage. Commercial general liability and property coverage are two of the most basic forms of business insurance.
Business Insurance Basics: Business Liability Insurance
Commercial General Liability
Commercial General Liability (CGL) policies cover four types of claims: bodily injury resulting in actual physical damage or loss, property damage or loss, personal injury (including slander or libel), and advertising injury. Often, it is offered in a package with Property coverage at very competitive rates.
Commercial liability insurance is not expensive but the cost to defend a claim can be catastrophic. One benefit of carrying general liability insurance is that for covered claims, damages, legal defense fees and settlement charges are all paid by the insurer up to the limits of the policy.
Your Techinsurance agent can provide you with recommended coverages and limits for your business liability insurance. He or she can also discuss with you optional coverages, or endorsements, you might wish to purchase for added protection against certain risks. If necessary, an Umbrella Liability policy can be purchased separately to extend coverage well above the limits of your standard commercial general liability policy.
Business Insurance Basics: Property Coverage
Property insurance protects your business property against physical loss or damage by theft, fire or other means. Because every business has property that could become lost or damaged, this form of business insurance is one of the first things you should buy when you start a company.
Property coverage can be structured several ways. In the most basic business insurance policies, Property coverage protects your furniture, computers, office equipment and other materials.
For many businesses, the most basic Property coverage is not enough. You may need a policy that insures data, papers, records, money and securities kept at your place of business. Sometimes this coverage is included in a basic Property policy (it may be listed as Valuable Papers or Media and Extra Expense coverage); if not, it can usually be purchased as an extra endorsement to your standard policy.
Business Insurance Basics: Package Policies (BOP)
Package Policies Combine General Liability and Property Insurance
When you evaluate business insurance, consider a package policy such as a Business Owner's Policy (BOP). A BOP combines Property coverage and General Liability insurance in a single business insurance policy.
You may find that by combining Property and General Liability insurance into a BOP, you can get better business coverage at lower rates than you would get from two separate policies.
Advantages and Exclusions to Business Owners Policy (BOP)
Not every business is eligible for BOP coverage. Business Owners Policy packages are especially designed for small- to medium-sized business operating in a low-risk business class. The BOP includes Commercial General Liability insurance and Property insurance for physical assets, such as office furniture and computers. The package policy may also cover loss of business income and extra expense.
A BOP generally insures lost or damaged property for replacement value, which means you'll receive enough from your settlement to replace the property at today's market value. The Property portion of a BOP also covers other people's personal property to the extent it would be covered under a standard Property policy.
The Liability coverage of a BOP is comparable to a typical Commercial General Liability (CGL) policy, providing protection against claims of bodily injury or property damage. The Liability portion also covers the cost of defending lawsuits that claim you are responsible for causing bodily injury or property damage. (Note: BOP Liability does not protect against professional errors or negligence normally covered by Professional Liability business insurance.)

BOP packages only satisfy a company's needs for Property and General Liability insurance. You will want to speak with your Techinsurance agent to obtain other appropriate forms of business insurance, including Workers' Compensation, Professional Liability, Employment Practice Liability, Commercial Automobile and other coverages your company may require.

Your business faces liabilities every day. The only way to protect your assets is to carry adequate business liability insurance. A Commercial General Liability (CGL) insurance policy is the first line of defense against many common claims.
General Liability insurance covers claims of bodily injury or other physical injury or property damage. It is frequently offered in a package with Property insurance to protect your business against incidents which may occur on your premises or at other covered locations where you normally conduct business. Commercial General Liability enables your business to continue operations while it faces real or fraudulent claims of certain types of negligence or wrongdoing.
Commercial General Liability - The Most Basic Form Of Business Insurance.
If you have only one form of business insurance, it is most likely Commercial General Liability. CGL policies cover claims in four basic categories of business liability:
Bodily Injury
Property Damage
Personal Injury (including Slander or Libel)
Advertising Injury
In addition to covering the claims listed above, Commercial General Liability policies also cover the cost to defend or settle claims - even if the claims are fraudulent.
Business Liability Insurance Keeps You In Business.
Every business benefits from adequate Commercial General Liability coverage. CGL insurance protects you if a customer is injured at your place of business. It would also cover damage or injuries caused by your employees at a client's site.
Commercial General Liability protects businesses against these types of claims. Even if your company is negligent or liable for damage, injury or loss to another's property, reputation or health, your business can keep its assets if it is adequately insured.
Commercial General Liability Only Protects Against Some Business Liabilities.
Even as a BOP (Business Owner's Package), where CGL insurance is combined with Property insurance at very reasonable rates, General Liability insurance does not protect your business against every liability. Professional Liability is a much-needed form of business liability insurance whose coverage takes over where Commercial General Liability leaves off.
Professional Liability insurance (also known as Errors and Omissions, or E&O coverage) is a separate type of insurance which protects your business against loss from a claim of alleged negligent acts, errors or omissions in the performance of your professional services. Professional Liability insurance is another important type of coverage to protect your business from potentially catastrophic claims.
Commercial General Liability Quotes.
Some companies make the mistake of thinking professional negligence or errors will be covered by a CGL policy. If you or your employees make professional judgements and recommendations in the course of your business, ask your agent or broker about a Professional Liability policy in addition to a CGL policy.
Commercial General Liability is less expensive than Professional Liability insurance. Ask your agent or broker to quote several coverage combinations, including CGL, Property and E&O coverage, to protect your business against a wide array of liabilities.
