Welcome to the home page of the New York Automobile Insurance Plan.
The New York Automobile Insurance Plan (NYAIP) is the central mechanism established
pursuant to Article 53 of the New York Insurance Law to provide auto liability and
physical damages coverages to those insureds who are unable to obtain such auto insurance
in the voluntary market. All insurers writing automobile insurance in New York State
must participate in the NYAIP by providing such insurance.
All agents and brokers holding a valid license to transact automobile insurance
business in New York State must be certified by the Governing Committee in
accordance with Standards and procedures approved by the Superintendent of Insurance prior
to submitting applications to the Plan.
Applicants must declare and certify that they have tried and failed to obtain
automobile insurance in New York State within the preceding 60 days and have been unable
to obtain such insurance at rates not exceeding those applicable under the plan.

Bar Coded ID Cards Deadline Extended
The state has decided to change the date bar coded ID cards will be
required to complete DMV transactions. The date has been moved from
October 1, 2001 to January 7, 2002. The complete announcement (in pdf

Quick/Free Access to NYAIP Assignment Information
The New York Automobile Insurance Plan (Plan) is pleased to announce the availability of its automated assignment
search Voice Response Unit (VRU). The VRU provides callers with immediate
assignment information for applications assigned through the Plan during
the preceding 3 months. The caller can quickly obtain assignment
information by calling our toll free number (866) 694-6084. Please have
the applicant's driver license number or vehicle identification number
available when making the call. The VRU will provide callers with the name
and contact number of the assigned carrier, the effective date of coverage
and the NYAIP application processing number. The service is free, fast and
easy to use with extended hours of operation available from 7A.M. through
11P.M.
In addition, the Plan has established a special e-mail address where producers can send requests for assignment
search information that cannot be accessed through the VRU. The Plan will
promptly reply to these requests by e-mail. Requests for Assignment
information searches can be sent to NYAIPINQ@AIPSO.COM
and must include the name, address, vehicle and date of registration for
applicant to be searched.
Producer Application Submission System (PASS)
PASS is an Internet based program which will enable certified producers to electronically submit applicant
information to immediately effect coverage for most private passenger applications
submitted to the Plan. There is no charge for this service. Additionally, this service
will provide use of a plain paper application.

New York auto insurers pressed to reduce assigned-risk pool

New York Superintendent of Insurance Gregory Serio wants auto insurers to reduce the state's assigned-risk insurer of last resort by more than 150,000 policies.
Serio's challenge to insurers is part of an overall revamping of New York's Automobile Insurance Plan that provides auto insurance to those who cannot get coverage from other insurance companies.
Serio has not included any potential repercussions for insurers if they fail to reduce the assigned-risk pool by the requested amount, and he has not put a deadline on the challenge.
Reducing the number of policies in the plan isn't a new idea. In 1995, the plan had over 1.5 million policies; in 2000 it was reduced to just 175,000. Now the plan is growing again, up to more than 350,000 policies, and Serio says he believes reducing that number is the best way to control auto insurance costs.
New York's assigned-risk auto insurance plan is still subsidized by the open market.
All auto insurance companies must take policyholders from the assigned-risk pool, and insurers increase their rates in the open market to offset losses in the assigned-risk plan. "That needs to stop in order to bring costs down," says Moran.
Serio sliced off 75 percent of a proposed rate increase from the plan, allowing an increase of 19.5 percent. Michael Moran of the American Insurance Association (AIA) says that increase is not enough to keep the assigned-risk plan from sucking up funds from the voluntary or open market insurers.
New York has been hounded by problems with no-fault insurance fraud that costs New York drivers an estimated $1 billion each year. State legislators, the governor, and Serio have all presented different plans for reducing fraud and the resulting costs.
New York Gov. George Pataki rolled out a rewritten Regulation 68 last year that was targeted at reducing the amount of time it takes to file a claim and subsequently cut down on fraud, but the changes were held up in court challenges until February, when a judge ruled them acceptable. The changes are still under challenge from appeals by trial lawyers and health care providers.
Serio says other new directives include implementation of an antifraud unit for the assigned-risk plan within 60 days, complete automation of the application process designed to reduce fraud, and requirement of a biannual public meeting of the plan's committee.
Serio has also expanded the voting membership on the assigned-risk plan's Governing Committee by adding 12 new members, including a consumer representative.
While Moran and others, including the Alliance of American Insurers, applaud Serio's efforts to reduce fraud, they aren't convinced that this is the right approach. The AIA states that what is needed to stabilize the New York market are "changes in Regulation 68, decertification of fraudulent medical providers, mandatory arbitration [of disputes], medical treatment guidelines for no-fault cases, and increased penalties for fraud."
